Plant Operating Conditions:
1. Backflow prevention devices shall be installed in the piping lines between the water storage tanks and the supply wells.
Administrative Conditions:
16. The Town of Nottingham Board of Selectman or its designee shall be notified in writing within five (5) working days if NHDES is notified of a violation of an Ambient Ground Water Quality Standard at or outside the Ground Water Management Zone boundary or if NHDES takes action to require investigations, remedial measures, or groundwater monitoring on this property or the Just Cause Realty Trust property, Town of Nottingham Tax Map 3, Lot 9. If the remedial action plan for the Just Cause Realty Trust property is revised, a copy of the revised plan will be transmitted to the Town of Nottingham Board of Selectmen at the same time it is transmitted to NHDES.
Water Monitoring Conditions:
24. Copies of all annual reports and monitoring data collected pursuant to the terms of the Large Groundwater Withdrawal Permit (LGWP) 2004-003 that are transmitted to NHDES shall be copied to the Town of Nottingham.
25. Notifications to the NHDES of any adverse impacts observed as a part of the LGWP monitoring shall be copied to the Town of Nottingham at the time of such notification to the NHDES.
26. If contaminants are detected at concentrations above New Hampshire Ambient Groundwater Quality Standards (AGQSs) or federal Maximum Contaminant Levels (MCLs) during any monitoring of the USA Springs supply wells, the permittee for LGWP 2004-003 shall notify NHDES and copy the Town of Nottingham Board of Selectmen within 72 hours. If warranted, following confirmation of contaminant impacts at the USA Springs supply well(s) and as determined in consultation with NHDES and the Town, water quality in residential water supply wells shall be tested on an agreed schedule in accordance with the protocols established in the Residential Well Monitoring Plan.
27. Summaries of ground water quality data collected pursuant to the Residential Well Monitoring Plan shall be transmitted to the Town of Nottingham annually. If USA Springs or its designee, in consultation with the Town or its representatives, observes an apparent increasing trend in detected contaminant concentrations and sufficient data are available for meaningful analysis, the summaries shall include the results of non-parametric statistical analyses of trends pursuant to the provisions of the Residential Well Monitoring Plan. Findings of contaminant concentrations at concentrations above New Hampshire AGQSs or federal MCLs shall be reported to the NHDES and the Town of Nottingham, or its designee, within 72 hours of receipt the laboratory data.
Attachment 2: Residential Well Monitoring Plan (entirely deleted)
The Town of Nottingham Planning Board (NPB) has requested that water quality monitoring be performed by USA Springs for residential supply wells located in the vicinity of its water bottling facility. This document describes the monitoring plan to be undertaken by USA Springs.
Drinking water samples will be collected at the 13 residential wells located in Nottingham that are identified for water level monitoring pursuant to Conditions Section 5.a.i of LGWP 004-0003. A water sample will also be collected from at least one additional residential supply well located along Route 4 between the water bottling plant location and the boundary line between the Towns of Northwood and Nottingham. The location of this well will be selected by USA Springs after consultation with NPB and its representatives.
Samples will be collected using sampling procedures and protocols described in the most recent edition of the U.S. Environmental Protection Agency's (USEPA's) "Practical Guide for Ground-Water Sampling," the most recent edition of USEPA's "RCRA Ground-Water Monitoring: Draft Guidance," and the New Hampshire Sample Collection & Preservation Manual for Drinking Water.
Samples will be analyzed for the New Hampshire Department of Environmental Services (NHDES) Petroleum & Hazardous Waste Remediation Full List of Analytes for Volatile Organics and radon by a laboratory certified by the USEPA or the NHDES using USEPA-approved methods for the specified parameters. Laboratories must achieve practical quantitation limits at or below NHDES Ambient Groundwater Quality Standards.
Monitoring will be performed in April and November, starting at least one year before the bottling facility begins operation, to establish baseline conditions, and continuing for two years thereafter. Subsequently, monitoring will be performed once each calendar year throughout the balance of the duration of the LGWP 2004-0003 (i.e., through July 1, 2014).
Summaries of water quality data will be submitted annually to the Town of Nottingham on a schedule consistent with LGWP reporting. Exceedances of AGQSs will be reported to the NHDES and the Town of Nottingham within 72 hours of receipt of laboratory results. If USA Springs or its designee, in consultation with the Town or its representatives, observes an apparent increasing trend in detected contaminant concentrations and sufficient data are available for meaningful analysis, the summaries shall include the results of non-parametric statistical analyses of trends (e.g., Mann-Kendall or Mann-Whitney or equivalent methods) of concentration trends at a 95 percent level of confidence. The annual data summaries can include recommended modifications to the residential well monitoring based upon results obtained through the date of the report.
